Mr. D. was driving to work when he was injured in an accident caused by another driver. He suffered seven broken ribs and bruises all over his upper body. The Accident

Mr. D. was driving on Double Bridges Road in Barrow County, Georgia. A driver going the opposite direction lost control of her car, came into his lane, and crashed into his car. Both cars were totaled in the wreck.  

The Injuries

Barrow County EMS responded to the accident. First responders noted that Mr. D. had severe chest pain when taking a breath and that his seat belt had caused contusions and abrasions from his left shoulder to his right hip. The EMTs used a backboard to fully immobilize Mr. D. and transported him to the emergency room at Piedmont Athens Regional Hospital. 

At Piedmont Athens Regional Hospital, the emergency room doctor ordered x-rays of Mr. D’s chest. They showed five broken ribs on his right side and two on his left. The doctor also noted a large seatbelt sign, which is bruising and abrasions in the shape of the seat belt.

There was nothing the doctors could do to treat the broken ribs except to give Mr. D. pain medication and send him home. He was in significant pain for several weeks and any sort of movement or activity caused his ribs to hurt. Even breathing caused him pain. He improved with time as his ribs slowly healed. He was unable to work at his job as a factory technician and lost thousands of dollars in income. Two months after the wreck, he was no longer having pain and his doctor cleared him to return to work and normal activities.

The Settlement

The driver who caused the accident only had $25,000 in insurance, which is the state minimum limit. Michael sent them a settlement demand and they quickly agreed to pay their policy limits.

Mr. D. also had $100,000 in uninsured/underinsured motorist coverage with the Georgia Farm Bureau. The UM coverage was “traditional” or “reduced-by,” meaning it is reduced by the amount of the other driver’s insurance. Since the other driver had $25,000 in insurance, this meant that Mr. D’s UM/UIM coverage provided $75,000 in coverage. Michael sent Georgia Farm Bureau a settlement demand, which they accepted, bringing the total settlement to $100,000.
